11/4/2009 WARN Act Summary

9/28/2009 Carriers - EDI POC
The NHDOL is currently in the process of testing the new EDI POC system with NCCI. Throughout this testing process we have noticed that many NCCI records are utilizing incorrect Federal Employer Identification Numbers (FEIN). It is essential for all carriers to update and correct any NCCI records that may have incomplete or incorrect data as the NHDOL utilizes the FEIN as the primary source of identification. By updating and correcting the NCCI records now, you can minimize any potential civil penalties for incomplete or invalid information when EDI POC is implemented.

8/5/2009 Employee Leasing Law Changes
Changes to the employee-leasing law, RSA chapter 277-B, were signed by the Governor on July 31, and become effective sixty days later on September 29, 2009. Click on the following link for more information. SB0167

One major change from prior law is that the employee leasing company can have two separate and simultaneous workers' compensation carriers, but only one carrier in the voluntary market and one in the residual market. Each client must be completely within one policy or the other, and both policies must clearly delineate which clients are included.

The new 277-B:9 clarifies which entity (the leasing company or the client) has what duties as the "employer" under what circumstances. For example, the leasing company is responsible for wages and taxes and employee manuals. The client is responsible for the goods and services it produces; wage-and-hour, safety, and discrimination compliance; and professional licenses.

Fines and civil penalties for violations of labor laws may be split between the leasing company and the client, depending upon the actual responsibility of each.


8/4/2009 Leasing News - Civil Penalties for late filings
Starting August 17, 2009, NHDOL will impose on an employee leasing company a civil penalty of $50 per day, for each day beyond 10 days, that NHDOL does not receive a proper notification of client company engagement or termination.

RSA 277-B:9 III requires an employee leasing company to notify the Commissioner of Labor in writing within 10 days of engagement or termination of a client company. This allows the NHDOL to track workers' compensation insurance coverage compliance, among other oversight duties.

Violation of this notification law may result in a civil penalty of "up to $1,000 per employee per day for each day the violation continues. "277-B:12 II.

6/18/2009 Second Injury Fund
Effective 7/1/2009 any final decision by the Special Funds coordinator or other representative of the department denying eligibility for reimbursement by the fund must be appealed to the Compensation Appeals Board within 30 days of the final decision.

1/15/2009 EDI Update
Beginning July 1, 2006 the New Hampshire, Department of Labor began accepting Injury Reports (NH Forms 8WC) via EDI. The New Hampshire Legislation mandated the reporting of workers claims via EDI.

Most are currently reporting claims via EDI today; the few exceptions are those who report a very small quantity of reports in a year. The department will be providing a WEB submission method in the near future to allow these low volume employers the ability to report workers claims electronically.

In August of 2008 the New Hampshire, Department of Labor signed an agreement with NCCI, to begin to accept the New Hampshire Form 6WC (Proof of Coverage) filings via EDI. As NCCI currently provides a service for the collection and reporting of proof of coverage information in several states, the New Hampshire, Department of Labor has designated NCCI as its agent to collect, store and report POC information. We are working on the development of this system with NCCI and expect to complete testing in February/March 2009. You must continue to submit your proof of coverage filings via paper until you are contacted by the department, NCCI or both, to notify you of the switch from paper filings to electronic filings.

The New Hampshire WEB site has been updated to include the POC EDI Information and documents.


12/1/2008 Mileage Reimbursement Rate Decrease
Mileage reimbursement payable under RSA 281-A:23 - Medical, Hospital and Remedial Care has been decreased from $0.585 to $0.55 for all miles incurred on or after January 1, 2009. See Mileage Rates
